At the Constitutional Convention in 1787 held at Philadelphia, representatives from the 12 states were present to witness the era of a new government. This was as a result of the ineffectiveness of the Articles of Confederation.

Under the Articles of Confederation, most of the powers were given to the Legislative Branch of government bringing about a weak central government. However, at the Convention, there were arguments on whether the Legislative branch of government should be Bicameral or Unicameral, particularly the structure of the Legislative branch.

At the Constitutional Convention, two alliances were formed as a faction namely; the Federalists and the Anti-Federalists. The Federalists wanted a proportional representation in government among the states based on their population called the "Virginia Plain". The Virginia Plan was suggested by James Madison, a Federalist. The Plan proposed three branches of government (Executive, Legislative and Judiciary) as opposed to having only the Legislative branch. It also proposes that the Legislative branch of government should have veto powers over the states.
