hypothesis refers to a suggested idea that is taken from an observed phenomenon mostly between two variables , this idea still need to be further tested in order to be accepted or rejected.

A theory on the other hand is a principle which explains events that has already been investigated and can be substantiated by data and evidence , which means it has been proven and verified.

Hypothesis is only a proposed presumption of that hasn't been proven or verified but still need to be evaluated through a test. It is usually formed before the test is carried out based on what had been reviewed.

Theory is accepted by most Scientists like the Big Bang Theory.

the fourth amendment protects:

"the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."  

so this would mean the denial to search and seizure without warrant or permission.
