The district court (trial court) accepted the individual defendants’ argument. What was that argument? On what reasoning did the appellate court reject that argument? If employees of a company that is violating the RCRA carry out disposal of hazardous substances in violation of the RCRA, they would presumably lose their jobs if they didn’t. What is the moral justification for applying criminal penalties to such employees (such as Hopkins and Angel)?
