There are two sides to the debate; On the one hand, there are those who propose that the law and rules of evidence ought to be as exclusionary as possible and only permit evidence that meets "the best evidence" criteria. The alternative view is that the law and rules of evidence ought to be as inclusionary as possible and only exclude evidence if it is prejudicial to a party. Prepare short notes on your thoughts on this debate remembering to point out the rationale for the position you have taken while using examples of either exclusionary or inclusionary rules of evidence in the Evidence Act, Cap 80 Laws of Kenya, case law and common law rules of evidence that are known to you.
