Ken Snodgras was editor-in-chief of the Bromfield News -Gazette. After he printed a
news story accusing Sheriff McBride of
corruption, the sheriff shut down the
newspaper under a state statue allowing local
sheriffs to close any newspaper they consider
a "public nuisance." Snodgras said that the
statue was unconstitutional. Is Snodgras
correct?
The U. S. Constitution's full faith and credit
clause would allow this type of statue
The statute is constitutional because the
injunction does not constitute cruel and
unusual punishment.
Any statue that violates the Fourth
Amendment's prohibition against
unwarranted searches is unconstitutional.
The statue violates freedom of the press,
which is guaranteed by the First
Amendment.
