Divided government occurs when one party controls the presidency while the other party controls at least one house of Congress.

Leave the Supreme Court out of any of these thoughts about "divided government."  The Supreme Court is not intended to be "working together" with the other branches of government or to be aligned with one or another political party.  The judicial branch of government provides a check and balance on the legislative and executive branches, but is intended to maintain its independence from them as well.
