Tucker agreed to pay Metal $10,000 and Metal agreed to an accelerated production schedule. Tucker is now convinced that his design is unworkable and refuses to accept or pay for the parts. Metal can find no other customers for these unique pieces. Metal has filed a complaint against Tucker for breach of contract, and Tucker has pleaded the statute of frauds as an affirmative defense.
