1. It was the free exercise clause which is part of the first amendment which basically allows you to do as youd please, in relation to this case it was on the basis of religion.

2.The first upheld that religion was an acceptable reason and protected by the first amendment. however in the second case they argued that since in the workplace the situation didn't directly involve religion that it was not protected.

3. They could introduce a bill that overturns the previous legislation or take a note/letter to the Supreme Court.
